Terms and Conditions
 
 
1 General

1.1 While NewsMonitors Ltd endeavour to deliver cuttings in an accurate and timely manner, no guarantee can be given that all relevant articles will be located or supplied by the requested time.

1.2 Clients may request changes to the service at any time, and provided they are agreeable to both parties can be implemented immediately. Oral requests are to be confirmed in writing.

1.3 NewsMonitors Ltd shall not be liable to the client for failure to deliver the agreed services due to any cause beyond our reasonable control.

1.4 The reading list agreed with the client is a guide only. NewsMonitors Ltd cannot guarantee that every publication/edition available is covered. 

1.5 Cuttings supplied do not represent NewsMonitors Ltd view on the subject matter, and NewsMonitors Ltd shall not be liable for any loss suffered by the client due to their subsequent interpretation.


2 Confidentiality

2.1 NewsMonitors Ltd treats all personal and company information as highly confidential and will only release information to a third party with the clients permission.


3 Copyright

3.1 To the best of our belief, NewsMonitors Ltd complies with all copyright, and has registered with the necessary licensing agencies.

3.2 Clients are advised that further reproduction of cuttings supplied may be an infringement of copyright and that advice/licence should be sought from the Newspaper Licensing Agency ( www.nla.co.uk ) or the Copyright Licensing Agency ( www.cla.co.uk ) 

3.3 NewsMonitors Ltd is required to print a copyright notice on each cutting, which may not be removed or altered by the client.

3.4 Clients may not store cuttings in an electronic archive or library

3.5 Newsmonitors is obliged to inform the NLA of any unlicensed copying 
brought to our attention.


4 Electronic Delivery

4.1 NewsMonitors Ltd is obliged to inform the NLA of all clients subscribing to the electronic service.

4.2 Cuttings will be made available on a secure section of NewsMonitors Ltd website for a maximum of 7 days.

4.3 Clients will be issued with a password for a specified number of users. NewsMonitors Ltd has to inform the NLA of the number of permitted users as part of our licence.

4.4 Clients with more than one permitted user have to hold a NLA licence.

4.5 Access of cuttings is limited to permitted users only.


5 Withdrawal of cuttings

5.1 Clients are obliged to destroy any copies of NLA cuttings if informed of their withdrawal.


6 Payment Terms

6.1 NewsMonitors Ltd invoices clients monthly in arrears. Payment terms are 30 days net.

6.2 Charges are exclusive of VAT. No less than one months notice in writing will be given should we become liable for VAT, at which time the client will become additionally liable at the current rate.

6.3 NewsMonitors reserves the right to charge interest on balances outstanding over 30 days.

6.4 Credit will be given for incorrect cuttings supplied, provided the client informs NewsMonitors Ltd within 2 days of receipt.


7 Termination

7.1 Termination by either party may be by one month’s written notice.
